HeyClogs (an Online Store Brand owned and operated by the legal entity FLY SHOE BOUTIQUE LLC) respects the intellectual property rights of others and expects its users and partners to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy toward copyright infringement.

We contractually prohibit the creation or sale of merchandise that infringes the intellectual property rights of third parties (including without limitation copyright, trademark, and related rights). If you believe that any content residing on or accessible through the heyclogs.com service infringes your rights, please follow the procedure outlined below.

A. Procedure for Reporting Intellectual Property Infringement

It is the policy of HeyClogs to:

  • Block access to or remove any content (including, without limitation, text, graphics, and photos) that it believes in good faith to infringe the intellectual property rights of third parties following receipt of a compliant notice.
  • Remove and discontinue service to repeat infringers.

To file a notice of infringement, please provide the following information to our Designated Agent:

  1. Identification of the copyrighted work or intellectual property that you claim has been infringed, including registration numbers if applicable.
  2. Identification of the material that you claim is infringing, including a description of where the material is located on the HeyClogs website with sufficient detail so that we may locate and verify its existence.
  3. Your full contact information, including name, physical mailing address, telephone number, and email address.
  4. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or are authorized to act on behalf of the rights holder.
  6. An electronic or physical signature of the person authorized to act on behalf of the rights holder.

B. Response to Infringement Notifications

Once a proper bona fide infringement notification is received, it is the policy of FLY SHOE BOUTIQUE LLC:

  • To remove or disable access to the allegedly infringing content.
  • To notify the party responsible for the content that it has been removed or disabled.
  • To terminate access for repeat offenders.

C. Counter-Notice Procedure

If you believe the content that was removed is not infringing, or you have the right to use such content, you must send a counter-notice containing:

  1. Identification of the content that has been removed and its original location on the HeyClogs Service.
  2. A statement, under penalty of perjury, that you have a good faith belief that the content was removed as a result of mistake or misidentification.
  3. Your full contact information (name, address, phone, and email).
  4. A statement that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located (or if outside the USA, for the State of Louisiana where the legal entity is registered), and that you will accept service of process from the person who provided the original notification.
  5. Your electronic or physical signature.

If a counter-notice is received, HeyClogs may send a copy to the original complaining party. Unless the rights owner files a court action, the removed content may be replaced in 10 to 14 business days after receipt of the counter-notice.
